Terms of Service

Welcome to Preserv! These Terms of Service ("Terms") govern your use of the Preserv recipe preservation service ("Service") operated by Preserv ("we," "us," or "our").

By using Preserv, you agree to these Terms. If you don't agree, please don't use the Service.

1. The Service

Preserv helps you:

• Capture and organize family recipes
• Polish recipes with AI assistance
• Create beautiful, gift-ready cookbooks
• Share recipes via QR codes and links
• Preserve memories with audio and video messages

2. Accounts

2.1 Registration

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account.

2.2 Eligibility

You must be at least 18 years old to use Preserv.

2.3 Account Security

You are responsible for all activity under your account. Notify us immediately at support@preserv.co.za if you suspect unauthorized access.

3. Subscriptions & Payments

3.1 Free Tier

The free tier includes:

• Unlimited recipes
• All capture methods (photo, paste, type)
• Manual editing
• Basic sharing via link
• 1 free digital cookbook per year

3.2 Preserv Plus

• Price: R249 per year
• Features: AI story & method writing, AI photo enhancement, voice & video keepsakes, QR code sharing, smart ingredients & servings, unlimited digital cookbooks
• Billing: Processed securely via PayFast

3.3 Billing Cycle

Subscriptions renew automatically each year. You will receive a reminder email before renewal.

3.4 Cancellation

You may cancel anytime from your account settings. Your subscription remains active until the end of the current billing period. No prorated refunds.

3.5 Refunds

If you're unsatisfied within 14 days of purchase, contact us at support@preserv.co.za for a full refund.

4. Your Content

4.1 Ownership

You retain full ownership of all recipes, photos, audio, and video you upload ("Your Content"). We claim no ownership rights.

4.2 License to Us

By uploading content, you grant us a limited license to:

• Store and display Your Content to you
• Process Your Content (e.g., AI polish, format conversion)
• Create backups for disaster recovery

This license ends when you delete your content or account.

4.3 Content Guidelines

You agree not to upload content that:

• Infringes on others' intellectual property
• Contains illegal material
• Violates others' privacy
• Is harmful, abusive, or hateful

We may remove content that violates these guidelines.

4.4 AI Processing

When you use the "Polish" feature, your recipe text is sent to OpenAI for processing. This is:

• Optional: You can skip AI polish entirely
• Ephemeral: We don't store your recipes in OpenAI systems long-term
• Private: Your content is not used to train AI models

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to access other users' accounts or data
• Interfere with or disrupt the Service
• Scrape or crawl the Service
• Resell access to the Service

6. Intellectual Property

6.1 Our Property

Preserv, including its design, code, and branding, is protected by copyright and trademark laws. You may not copy, modify, or distribute our materials without permission.

6.2 Feedback

If you provide suggestions or feedback, we may use it to improve the Service without compensation to you.

7. Privacy

Your privacy matters. See our Privacy Policy for details on how we collect, use, and protect your personal information.

8. Disclaimers

8.1 "As Is" Service

The Service is provided "as is" without warranties of any kind. We don't guarantee:

• Uninterrupted or error-free operation
• That the Service will meet all your needs
• The accuracy of AI-generated content

8.2 Recipe Accuracy

AI polish is a creative tool. Always review AI-generated content before sharing or printing. We are not responsible for recipe accuracy or dietary issues.

9. Limitation of Liability

To the maximum extent permitted by South African law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months
• You agree to indemnify us against claims arising from your use of the Service

10. Changes to Terms

We may update these Terms from time to time. We'll notify you of material changes via email. Continued use after changes constitutes acceptance.

11. Termination

11.1 By You

You may delete your account at any time from account settings.

11.2 By Us

We may suspend or terminate accounts that violate these Terms. We'll provide notice unless immediate action is required for security reasons.

11.3 Effect of Termination

Upon termination:

• Your access to the Service ends
• We delete your data within 30 days
• You may export your content before termination

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of South Africa.

12.2 Jurisdiction

Disputes will be resolved in the courts of Johannesburg, Gauteng.

12.3 Informal Resolution

Before legal action, you agree to contact us at support@preserv.co.za to attempt informal resolution.

13. General

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Preserv.

13.2 Severability

If any provision is found unenforceable, the remaining provisions continue in effect.

13.3 Waiver

Our failure to enforce any right doesn't waive our ability to enforce it later.

13.4 Assignment

We may assign these Terms; you may not without our consent.
